Application for Shellfish Aquaculture Leases - Pomeroy

Little Choptank River, Dorchester County

The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, §4-11A-09(g), Annotated Code of Maryland, is giving notice of applications for three shellfish aquaculture submerged land leases by Frederick C. Pomeroy in the Little Choptank River, Dorchester County, Maryland.

The first proposed area, in the Little Choptank River near Smith Cove, contains 6.6 acres, more or less, and is enclosed by a line beginning at corner 1, at or near Lat. 38° 33' 28" N., Long. 76° 10' 46" W., then running 278° 49' (True), approximately 101 meters to corner 2, at or near Lat. 38° 33' 28.4" N., Long. 76° 10' 50.2" W., then running 23° 55' (True), approximately 284 meters to corner 3, at or near Lat. 38° 33' 36.9" N., Long. 76° 10' 45.6" W., then running 142° 23' (True), approximately 144 meters to corner 4, at or near Lat. 38° 33' 33.2" N., Long. 76° 10' 42" W., then running 211° 9' (True), approximately 188 meters to the point of beginning.

The applicant proposes to deposit oyster shell as needed within each of the given areas to a maximum depth of 4 inches for the purpose of culturing Eastern Oyster (Crassostrea virginica), and to harvest using methods approved by the Department. Maps of each of the proposed leasess are available below.

The Department will hold a public informational meeting upon written request from a member of the public. In addition, any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by one or more of the proposed leases may file a Petition of Protest with the Department. Petitions that meet the requirements of Natural Resources Article §4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication. Written requests for public informational meetings and/or Petitions of Protest must be received by the Department of Natural Resources Aquaculture Division 580 Taylor Avenue C-2 Annapolis, MD 21401 by April 22, 2013.
